Version Notes

This IPR is slightly modified from the 1/14/2025a version to account for some additional language modifications that were missed in the 1/14/2025a revision:

• 2.8: added “(excluding design patents and design registrations)” to bring the definition more in line with other SDOs (i.e., W3C)
• 4.1: added the language to “[in any] portion of the Submission that is subsequently incorporated in the [Final Output] to which it was submitted…”; in addition, the following was added to the end of the clause: “A Member who continues to participate in the Working Group cannot object to the inclusion of its Essential Claim(s) in a future version of the Working Group Output under Section 4.3 if (i) the Essential Claim(s) cover the Member’s own Submission to the prior version of the Output under this section; (ii) those same claim(s) were Essential Claim(s) to a prior version of the same Output, and (iii) the subsequent version of the same Output uses the Essential Claim(s) in a substantially similar manner and to a substantially similar extent with a substantially similar result as the Essential Claim(s) were used in the prior version of the Output on which the Member made the Licensing Commitment.”
• 4.7: updated the language to clarify meaning of the Defensive Suspension clause.
• 9.2: added “Submission was made” to the end of (i) to align with previous revisions in 4.1
